Who can be a Registered Agent?
Domestic and foreign corporations registered in Idaho must always maintain a registered agent.[2]
An agent can be an individual or a business. The agent must be available during normal business hours at a specific street address to accept service of process and other legal documents. The agent’s address may not be a UPS Store or a PO Box.[3]
If a commercial registered agent has the same name as another commercial registered agent on file, then that agent must adopt a fictitious name that’s distinguishable from the other.[4]
Can I be a Registered Agent?
Yes, as long as you are a resident of Idaho or a business authorized to do business in Idaho. The simplest way for a company to select a registered agent is to include the agent’s name and address in the forms filed to create the company. File these forms through the Secretary of State’s website, or select the appropriate form below.
Mail or deliver it to the Office of the Secretary of State, 450 N 4th Street, PO Box 83720, Boise ID 83720-0080. A paper form incurs an additional $20 processing fee.[5]
Changing a Registered Agent
To change a registered agent, file a completed Statement of Change form with the Secretary of State. Enclose a $20 filing fee and mail or deliver to Office of the Secretary of State, 450 N 4th Street, PO Box 83720, Boise ID 83720-0080.
The form should not be used to change a mailing address. To do this, use company stationery and state both the old address and the new address. Include the signature of a person authorized to sign documents on the company’s behalf.[6]

To resign as a registered agent, file a Statement of Resignation of Registered Agent with the Secretary of State. There is no filing fee.
A statement of resignation takes effect at 12:01 a.m. on the 31st day after the statement is filed or when a new agent is designated, whichever comes first. The agent may resign whether or not the entity is in good standing with the state.[7]
